"Company," "we," "us," and "our" refer to The Limping Sailor, LLC, a Texas limited liability company. "User," "you," and "your" refer to any individual or entity accessing or using the SMAC Protocol, API, or any associated services (collectively, the "Service").
SMAC Protocol is a sovereign AI memory and authentication chain infrastructure. The Service provides cryptographically-verified persistent AI memory, tamper-evident chain records, and associated APIs. All capabilities are described in documentation provided at smacprotocol.ai.
You must be at least 18 years of age and have the legal authority to enter into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements.
All technology, architecture, protocols, patents, trademarks, and intellectual property underlying the SMAC Protocol — including but not limited to SMAC™, Sovereign AI Memory™, the authentication chain architecture, the knowledge tree structure, and all associated innovations — are the exclusive property of The Limping Sailor, LLC and are protected by pending and issued patents, trade secret law, and applicable intellectual property law.
Access to or use of the Service does not grant you any ownership, license, or rights in any intellectual property of The Limping Sailor, LLC beyond a limited, revocable, non-transferable right to use the Service as expressly permitted under these Terms.
Reverse engineering, decompiling, disassembling, or attempting to derive the source code, architecture, or underlying methods of the Service is strictly prohibited.

Your use of the Service is also governed by our Privacy Policy, incorporated into these Terms by reference. The SMAC Protocol is designed for sovereign, local deployment. Data handling practices are described in the Privacy Policy.
The Service is currently in private beta. Beta services are provided "as is" without warranty of any kind. Features, APIs, and availability may change without notice. The Limping Sailor, LLC reserves the right to terminate beta access at any time for any reason.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED AVAILABILITY. THE LIMPING SAILOR, LLC MAKES NO WARRANTY THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LIMPING SAILOR, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. THE LIMPING SAILOR, LLC'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNTS PAID BY YOU IN THE SIX MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless The Limping Sailor, LLC and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or your violation of these Terms.
These Terms shall be governed by the laws of the State of Texas. Any disputes shall be resolved in the state or federal courts located in Montgomery County, Texas. Both parties consent to the personal jurisdiction of such courts.
The Limping Sailor, LLC reserves the right to modify these Terms at any time. Changes will be posted at smacprotocol.ai/tos with an updated effective date. Continued use constitutes acceptance of revised Terms.
